Terms & Conditions
All Inclusive Culture Strategy programs are owned and copyrighted by Willing Observers LLC. The following constitute the terms and conditions, to which participants agree when purchasing a subscription to any Inclusive Culture Strategy program, below referred to in the aggregate as “Terms and Conditions.”
1. Registration When booking a training, you agree to provide true, accurate, current and complete information about yourself as prompted by the registration form.
2. Booking & Access
2.1. Program registrations are done via the Inclusive Culture Strategy website, www.inclusiveculturestrategy.com. Registered participants will receive a separate e-mail containing instructions for logging into the learning management system. Additional information on registering and attending the live sessions are provided in the learning management system.
2.2. Registered participants will need to create an account to log into the learning management system. Participants will also need a Zoom account to participate in the live sessions. Free Zoom accounts are available at www.zoom.com.
2.3. Participants have one year to complete an Inclusive Culture Strategy program for programs that have more than 20 learning hours. Their access termination date to the Inclusive Culture Strategy learning management system will be one year from payment date. Participants enrolled in programs shorter than 20 learning hours will have their access termination date posted on their invoice. Learning hours for each program are posted on the course description.
3. Prices and discounts
3.1 Notice of new pricing will be given in advance, but Willing Observers LLC reserves the right to change prices listed without notice.
3.2 Discounts may be available for any or all of the programs on a periodic basis. Discounts are subject to availability.
3.3 If three or more people from the same organization book the same program, they qualify for a 15% discount off the combined training price. Contact info@willingobservers for more information.
3.5 The registration costs include access to the learning management system for the selected program, which contains recorded videos, course materials, and references.
3.6 No more than one discount code can be applied at any given time. Discount code must be applied at time of registration and payment; it cannot be applied retroactively.
4. Payment Fees must be paid and discounts must be applied at the point of booking via Inclusive Culture Strategy website, www.inclusiveculturestrategy.com. The Inclusive Culture Strategy website is hosted by Squarespace and payment is secured through Stripe, which is under strict legal and contractual obligations not to disclose payment information to third parties.
5. Prevailing terms and conditions
5.1 All Inclusive Culture Strategy programs are provided by Willing Observers LLC on the basis of these Terms and Conditions. Participation in any Inclusive Culture Strategy program is subject to these Terms and Conditions.
5.2 We reserve the right to make any amendments to the terms and conditions at any time to reflect changes affecting our business, including but not limited to, changes in technology, payment methods and legal and regulatory requirements. By continuing to use this site you agree to accept any changes made to the terms and conditions.
6. Ownership and intellectual property rights All video recordings and content developed by Willing Observers available via the Inclusive Culture Strategy learning management system is owned by Willing Observers LLC. All intellectual property rights in all materials including the design, graphics and text of all materials and the audio and video of all recordings developed by Willing Observers, including but not limited to lesson recordings, podcasts, and micro-learning videos, are owned by Willing Observers LLC. No content of any program may be copied, reproduced, uploaded, posted, displayed or linked to in any way, in whole or in part, without the Willing Observer LLC express written permission. Program participants may download and use content marked as “Resources” for their private use or for use limited to their roles in their organization. Any other such use is strictly prohibited and will constitute an infringement of Willing Observers LLC intellectual property rights. For questions, contact info@willingobservers.com.
7. Video recording No video recording is allowed during virtual live sessions.
8. Accommodations Captioning is provided for all Inclusive Culture Strategy program recordings developed by Willing Observers. Additional requests for accommodations must be submitted to info@willingobservers.com as soon as possible following registration and as participants proceed with the lessons.
9. Conduct Willing Observers LLC reserves the right to remove any participant from a program whose conduct is deemed inappropriate by Willing Observers LLC or its trainers. In these circumstances, Willing Observers LLC will neither refund any fees nor reimburse any other costs.
10. Trainers Co-Founders of Willing Observers LLC develop most of the Inclusive Culture Strategy programs content. For live sessions, Willing Observers LLC members reserve the right to in its sole discretion substitute any trainer with any other person who Willing Observers LLC in its sole discretion deems qualified to present the relevant course. While the Inclusive Culture Strategy Certificate and Inclusive Culture Strategy Certified Diversity Professional Certification lessons are provided and developed by Willing Observers LLC Co-Founders, lessons in these programs and other programs and lessons may be provided and developed by trainers who Willing Observers LLC in its sole discretion deems qualified to present the relevant content.
11. Technology Willing Observers LLC does not warrant that the provision of any content online will always be available or be uninterrupted, timely or error free, that defects will be corrected or that such content is secure or free from bugs, viruses, errors and omissions.
12. Joining Instructions Joining instructions to live sessions are posted on the learning management system and reminders are sent via email one week prior to the live session. Registered participants are responsible for confirming receipt of joining instructions and virtual access link prior to the training date. Willing Observers LLC is not held liable for non-receipt of joining instructions.
13. Personal data Willing Observers LLC does not publish, give, sell, or transfer the personal data you provide when you book the training course. Personal data will be used by Willing Observers LLC for the purpose of delivering your training course and marketing of Willing Observers LLC services. Your full name, job title, and employer may be shared with your trainer.
14. Refunds, Credits, and Cancellations
14.1 Cancellation of a training course All sales are final. Refunds are only allowed in limited and extreme extenuating circumstances for which documentation is required. No other refunds will be made. In lieu of a refund, participants may transfer their registration to a different participant.
14.2. Credits & Transferring Registration In lieu of a refund, participants may transfer their registration to a different participant. To qualify for a transfer, participants must not have received any Credly badge.
14.3. Transfer Notice Transfer requests must be made within the first six months of registration to the Inclusive Culture Strategy program. The transferred participant will have at a minimum the remaining six months to complete the course.
15. Changes and/or Cancellation to a program made by Willing Observers LLC Willing Observers LLC reserves the right to alter or cancel a program at any time in extreme circumstances. If Willing Observers LLC has to cancel a program, the following will apply:
Willing Observers LLC will try to reschedule the program availability and will inform you of the rescheduled dates.
if Willing Observers LLC is unable to reschedule the program, they will offer registered participants a free transfer to the next available program of equivalent value.
if registered participants are unable to participate in the alternate program, Willing Observers LLC will offer them a 100% refund of the fee. Refunds will be processed within 60 days of receiving a refund request via bank transfer to the original payer.
16. Changes and/or Cancellation to a live session hosted by Willing Observers LLC
Willing Observers LLC reserves the right to alter or cancel a live session at any time up until the day of the session in extreme circumstances. If Willing Observers LLC has to cancel a live session, the following will apply:
Willing Observers LLC will try to reschedule the live session and will inform you of the rescheduled dates.
if registered participants are unable to participate in the total of live sessions needed to graduate from their program, Willing Observers LLC will consider make-up assignments to be completed in consultation with Willing Observers LLC. All make-up assignments must be completed before the end of the participant’s access to their respective Inclusive Culture Strategy program.
17. Non-attendance If participants fail to attend the number of live sessions required of their program, Willing Observers LLC will be unable to refund the course fees or offer a transfer or credit to another program. Participants will not be able to claim the program completion Credly badge.
18. Program extension If a participant wishes to extend their access to an Inclusive Culture Strategy program, they may do so on a yearly basis at a discounted 50% rate of the full cost of the program. To do so, they must contact ics@willingobservers.com at least 48 hours prior to their access termination date. Participants returning after their access termination date will have to pay full price for a new registration into the program.
